Confined Space "Conundrum"

 A confined space must be large enough to enter, have a restricted means of entry and exit and not be designed for continuous human occupancy.   A question that was just posed to me recently was


"Do confined spaces have to be a particular depth before they are considered confined spaces?" 


What are your thoughts on this question?  Is an open top tank that is 3 feet deep a confined space?  Does your company or workplace establish a particular depth for a confined space?  If so what is it and why?
