Theater Railing Heights

I am evaluating a balcony railing at a theater, and wanted an opinion on theater railing heights.  In the photo the higher railing (at the foot of the aisle" is 42".  The railing to the right is 32".  It seems low and unable to protect someone against a fall.  I know there are exceptions allowed for sight-lines, but would those exceptions be permitted in a cross aisle with no seats below the railing as mentioned in 12.2.11.1.3?
