Ambulatory Surgery Center Construction Requirments

Hello everyone, I have a surgery center located on the first floor of a un-sprinklered, 2 story, Type II (000) structure. The state surveyor is making the center install sprinklers throughout the entire building. My interpretation of the code (NFPA 101-2012, table 21.1.6.1) is as follows; as long as the surgery center is not on or above the 2nd floor of the building described above it was permitted. These are ASC's that have been occupied for years, passed multiple deeming state and accreditation agency surveys with this never being a problem. I feel that the intent of the code is being enforced incorrectly. Any thoughts?
